[1] Medical payments coverage, however, is primary which means the medical payments coverage must be exhausted until the health insurer begins to make payments.  Similarly, Medicare may choose not to not make payments if there is a responsible third-party.  Most of the time, however, Medicare will make a conditional payments and seek repayment after the case is settled.
