Davis Kelin Law is proud to announce that a verdict was reached in one of the largest insurance bad faith cases ever in New Mexico. It took a decade of legal battles before a jury delivered the verdict against Public Underwriters Liability Insurance Company (PULIC).
Davis Kelin has handled numerous cases involving the unfair practices act in the past with great success. Our firm is dedicated to holding insurance companies accountable so that they keep their promises to their insured.
Principal Ben Davis of Davis Kelin had this to say about the verdict: “These families faced immense pain and devastation, and to add insult to injury, they were unable to have justice enforced for over a decade due to unfair insurance practices.”
A doctor insured by Public Underwriters Liability Insurance Company was at the center of a medical malpractice case that resulted in wrongful death. PULIC refused to defend the doctor for the claims that the families brought against him.
The New Mexico District Court determined that PULIC breached its insurance contract and violated the Unfair Insurance Practices Act in New Mexico. The $52 Million settlement reflects the amount of disregard that was shown to the insured.
Davis Kelin Law has built a law practice that everyone can be proud of because our attorneys are not hesitant to take an insurance company to court when it is necessary and in the best interest of our clients. Policyholders absolutely should expect insurance companies to follow through with their promises and act in good faith by honoring their contractual obligations.
